What we collect, and why
We collect only what we need to answer you and to run the business. In plain terms:
Information you type into a form
When you submit any form on this site — the address and phone fields on our selling, buying, rental and property-management pages, the home value request, a rental application, or the chat assistant's contact form — we collect what you enter. Typically that is your name, email address, phone number, and the property address or area you ask about, together with anything you write in a message box.
We use it to respond to your enquiry, to prepare a valuation or rental analysis, and to send you information you asked for.
How you found us
To understand which marketing actually works, each submission also records the campaign parameters in the link you arrived through (UTM source, medium, campaign, term and content), the page you landed on, and the site that referred you. This is attached to your enquiry — it is not a browsing history and it is not used to follow you across other websites.
Consent, recorded in detail
Where a form asks for permission to call or text you, we store a record of that consent: the exact wording you were shown, the time you agreed, the page you were on, and your browser's user-agent string. If you later withdraw consent, we record that too. Keeping the wording is how we can prove what you actually agreed to.
Your conversations with the assistant
Our chat assistant asks about your situation — for example whether you want to buy, sell, rent, or have a property managed — so it can route you to the right person. The answers you give are stored with your enquiry. Your chat messages are also sent to a third-party AI provider to generate replies (see "Who else sees your information" below).
The assistant is deliberately built not to state prices, rents, availability, or appointment times, because it has no access to that data. It qualifies and routes; a person confirms the details.
Address autocomplete
Property address fields suggest matches as you type, using Google Places. What you type into an address field is sent to Google to produce those suggestions.
What we do not collect
We do not ask for your Social Security number, driver's licence number, bank details, or card numbers anywhere on this website, and those details should never be typed into it. Where tenant screening is required, it happens through a separate, dedicated provider flow with your written authorisation.
Who else sees your information
We do not sell your information, and we do not share it for anyone else's marketing. We use a small number of service providers who process it only on our instructions:
- Supabase — database hosting and staff sign-in. Your enquiry and its consent record are stored here.
- Google Places — address autocomplete. Receives the partial address you type.
- Our AI provider — receives your chat messages so the assistant can reply. We use a single contracted provider for this.
- Cloudflare — serves the website and handles network security.
- Cloudflare Web Analytics — cookieless, aggregate site statistics. No personal data, no cross-site tracking.
- Our own database (Supabase) — anonymous listing-view counts: which listing, a random per-visit identifier, and when. No IP address and no personal data.
We may also disclose information where the law requires it, or to protect our legal rights.
If you would like to know which AI provider is currently in use, ask us using the contact details above and we will tell you.
Cookies and storage on your device
This site does not use advertising or cross-site tracking cookies.
We do measure how the site is used, so we can tell which pages are useful. That is done with Cloudflare Web Analytics, which is cookieless: it sets no cookies, collects no personal information, and does not follow you to other websites. It gives us aggregate numbers — page views, referring site, country, device type — not a profile of you. Because it stores nothing on your device and identifies nobody, it is not the kind of tracking that requires a cookie banner.
Which homes people look at. Cloudflare tells us how many people visit the listings page, but not which homes they opened, because it is cookieless and only counts pages. To learn which listings attract interest, we record a listing view in our own database. That record contains only:
- which listing was viewed, identified by its address;
- a random identifier created in your browser for that visit — not your name, email, IP address, or anything derived from your device;
- the date and time.
That random identifier is held in your browser's session storage and is deleted when you close the tab. We do not link it to you, we do not follow you to other websites, and we do not use it to build a profile. Repeat views of the same listing during one visit are counted once. If you submit an enquiry during the same visit, we may be able to tell that the enquiry followed a particular listing view — that is your own enquiry, and it is the only way this data is ever connected to a person.
We keep these counts in aggregate to decide which properties to feature and how to price and market them. They are not sold, and they are not used for advertising.
Your activity, once you contact us. So that our agents can help you with the homes you are actually interested in, the site also keeps a second random visitor identifier in your browser's local storage. Alongside it we record when you visit and which homes you open or save (the listing, its price and city), and how long a home's page was open on your screen. On its own this identifies nobody. If you send us an enquiry, the identifier is stored with your enquiry, and your agent can then see your website activity: when you last visited, how many times, which homes you viewed or saved, and how long you spent on each. This is the same kind of activity history most real-estate websites keep for their clients. It is used only by Upside to follow up with you; it is never sold or shared for advertising.
Links we send you. Links to this website in texts and emails we send
you carry a short code (ut=). Opening one tells us the browser belongs to you, so the
homes you open there show in your activity too. The code is removed from the address bar as the
page opens. If your browser sends a privacy signal (below), opening the link records nothing.
Live chat. If you have contacted us, your agent can send you a message that pops up on the page you have open, and you can reply in that window. While a page of this site is open in front of you, your agent can see that you are on the site and which page you are on; nothing is recorded for that. The messages themselves are kept with your enquiry, like texts and emails we exchange with you. You can only reply to a chat your agent started, and you can close it at any time.
If your browser sends a Global Privacy Control or Do Not Track signal, no visitor identifier is created and none of this is recorded. You can also clear it at any time by clearing this site's data in your browser, or ask us to delete your activity using the contact details above.
This site also stores a small amount of information in your browser's local storage so it works sensibly during a visit:
- A copy of enquiries you submit, so nothing is lost if the network fails.
- Contact details you have already given us, so we do not ask for them again on the next form.
- Whether you have already opened or dismissed the chat assistant.
This information stays on your device. You can clear it at any time through your
browser's settings, and you can inspect it yourself in the browser console with
UpsideLeads.all().
How long we keep it
We keep enquiries for as long as we need them to serve you and to meet our record-keeping obligations as a licensed real estate business. If you ask us to delete your information, we will do so unless we are required to keep a particular record by law.
Your choices and rights
You can contact us at any time to:
- Ask what information we hold about you, and get a copy.
- Correct anything that is wrong.
- Ask us to delete your information.
- Withdraw your consent to be called or texted — you can also reply STOP to any text message.
We will not treat you differently for exercising any of these choices.
Consent to marketing is never a condition of buying, selling, renting, or having your property managed.
Security
Enquiries are stored in a database with row-level security, so the public website can write an enquiry but cannot read anyone else's. Access to stored information is limited to authorised Upside staff. If a breach ever affects your personal information, we will notify you as required by South Carolina law.
Children
This website is intended for adults. We do not knowingly collect information from children.
Changes to this policy
If we change how we handle your information, we will update this page and move the "last updated" date above. Material changes affecting information we already hold will be communicated to you directly.
